This action follows an extensive investigation that spanned 11 months and was prompted by the spill's devastating impact along the Doñana coastline, specifically between MazagĂłn and Matalascañas. The proposed penalty breaks down as follows: €100,000 for negligent dumping practices, €170,000 to cover the cleanup efforts executed by Salvamento MarĂtimo and the Port Authority of Huelva, €30,000 for failing to timely report the spill, and an additional €10,000 for inaccuracies found in the ship's logbook. The investigation concluded that the spill emerged due to negligence while 'Herbania' was docked at the Port of Huelva, receiving fuel from the tanker 'Oizmendi'. Alarmingly, the oil spill spread over a kilometer before the ship's captain or Petrogás reported any issues—only informing authorities two days later about an overflow that reportedly did not surpass the vessel's deck level. DISA, the parent company of the naval operation based in Santa Cruz de Tenerife, has yet to receive official notification of the proposed fine and intends to wait until the documentation arrives to formulate a response and submit any objections.

The 'Herbania', a vessel arriving from Huelva, has been docked at Terminal Contendres in Cadiz since December 16, 2019, because of a bearing failure in its reduction gearbox. This incident marks the second such failure for the ship since October 2017, with the current issue being deemed more severe than the previous fault involving the Hyundai FPGV 660. After repairs, the Herbania departed the port at 7:45 p.m. on January 6 and continued its journey back to Huelva. By January 7 at 1:00 p.m., the ship had successfully moored off its destination, located at coordinates 37° 6.34' N and 006° 52.71' W.
