Judicial Action Takes Four Svitzer Tugs Offline Amid Sakhalin-2 Project Dispute

However, on April 17, 2023, Svitzer Sakhalin announced the immediate suspension of their contract, citing force majeure. They referenced communication from Svitzer regarding the proposed termination of the bareboat charters, vessel flag changes, and relocation from Russian territorial waters. The court clarified that the interim measures are essential for ensuring the claimant’s continued ability to utilize the tugs under the existing contracts, thereby facilitating the ongoing operations of the Sakhalin-2 project. The ruling by the court has immediate effect but allows for a one-month window for potential appeals. Notably, Sakhalin Energy LLC, the newly appointed operator of the Sakhalin-2 project, began operations on August 19, 2022. This entity has assumed both the rights and obligations held by SEIC, which was previously in control of Sakhalin-2 until it was restructured in a deal involving several stakeholders, including Gazprom (50%), Shell (27.5%), Mitsui (12.5%), and Mitsubishi (10%). The Sakhalin-2 facility, recognized as Russia's first LNG plant, produces approximately 11.5 million tonnes of liquefied natural gas annually, sourcing its gas from the Piltun-Astokhskoye and Lungskoye fields on the Sakhalin shelf.
