Maersk Line Ltd. Revamps Safety Reporting Policies Following Whistleblower Settlement

Jul 27, 2024 16:39

In a significant development, Maersk Line, Ltd., the U.S. arm of the global shipping giant, has opted to revise its safety reporting procedures and provide compensation to a former seafarer after engaging in a legal battle with the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA). The decision arises from a 2020 incident involving the dismissal of a chief mate who raised safety alarms directly to the U.S. Coast Guard regarding the vessel 'Safmarine Mafadi', now known as the 'Maersk Tennessee'. During a comprehensive three-day hearing in June 2024, Maersk Line, Ltd. contested OSHA’s 2023 ruling that deemed the termination of the officer illegal. The unnamed chief mate had highlighted several critical safety issues, including the urgent need for lifeboat repairs, potential alcohol use among crew members, inadequate supervision of cadet seamen, and an ineffective bilge system which failed to prevent water ingress in cargo holds. Following the report, the U.S. Coast Guard conducted an inspection that uncovered violations onboard. However, shortly after the inspection, the chief mate was suspended and subsequently fired three months later under the claim of not adhering to company policy, which mandated that safety concerns be reported through the internal hierarchy before contacting authorities. OSHA determined that this policy infringed upon the U.S. Seaman's Protection Act, which upholds the right of seamen to report safety issues to the Coast Guard without fear of retaliation. In the aftermath, Maersk Line, Ltd. was ordered to reinstate the chief mate, compensate him with over $450,000 in back wages along with $250,000 in punitive damages. MLL, upon appeal, has opted for a settlement that includes an overhaul of its reporting structure, eliminating any prerequisites for employees to inform the company prior to contacting safety authorities. Moreover, the shipping line committed to implementing anti-retaliation measures and providing training for supervisors on the updated safety protocols. As stipulated in the agreement, the former chief mate has accepted the settlement terms while the company has agreed to erase any negative references related to the termination from the mate's employment record, ensuring that a neutral reference will be available upon request. Importantly, there was no indication of the mandated rehiring, and Maersk Line, Ltd. did not acknowledge any violations concerning the Seaman's Protection Act. MLL previously defended its actions by arguing that the International Safety Management (ISM) Code obliges crew members to report issues up the chain of command, while suggesting that the chief mate’s report was made in bad faith, citing that the Coast Guard had cleared the vessel post-inspection.
