Ongoing Legal Challenges for MSC in Vizhinjam Amid Vessel Detentions
The legal challenges facing Mediterranean Shipping Company (MSC) in India are intensifying, particularly at the Vizhinjam Port where the Kerala High Court has been siding with plaintiffs. This comes as the court has ordered the detention of MSC vessels, namely the 'MSC Palermo' and 'MSC Makoto II', as collateral for a growing number of claims stemming from the incident involving the sinking of the 'MSC Elsa 3'. The latest court session took place on August 14, 2023, following the filing of six separate admiralty claims. Court documents reveal that the plaintiffs allege that fishing nets and other fishing gear became entangled with debris from the 'MSC Elsa 3' wreck. An interim court order resulted in the detention of the 'MSC Makoto II' at Vizhinjam pending the posting of a bond by MSC. Meanwhile, four Indian fishermen have also lodged claims with the High Court, stating that their fishing vessels were damaged due to debris floating underwater following the 'MSC Elsa 3' incident. The fishermen reported severe damages, including lost metal chains and fishing ropes. The timing of the claims coincided with the 'MSC Palermo's' scheduled arrival in Vizhinjam, leading to demands for the vessel's arrest until the court could address the claims. On August 12, the High Court ruled in favor of the plaintiffs, resulting in the detention of the 'MSC Palermo'. MSC representatives managed to post a bond against the claims, resulting in the vessel's subsequent release, allowing it to continue its journey on August 13. As for the 'MSC Makoto II', it departed Vizhinjam on August 16, heading towards Haldia with an expected arrival date of August 20. This incident marks the fourth and fifth instances where MSC vessels have been detained due to legal claims. Earlier in June, the 'MSC Polo II' faced brief detention over a claim from the Cashew Board, followed by the 'MSC Manasa F' being held for similar reasons. Both vessels were later released after MSC posted required bonds. In a separate and ongoing matter, the 'MSC Akiteta II' remains detained in connection with a substantial $1 billion claim filed by the local state. As of August 16, MSC has yet to post a bond for the release of 'MSC Akiteta II', which continues to remain at Vizhinjam Port with uncertain prospects for release in the near future.
