Utopia IV Crew Receives $2.9 Million After Collision with Tropic Breeze

Apr 23, 2025 12:39

In a landmark decision, a Florida jury has awarded $2,888,300 in damages to three former crew members of the luxury yacht 'Utopia IV' following a lawsuit against the yacht and Utopia Yachting LLC. The plaintiffs, identified as Eric Ward, Samuel Parrott, and Fred Wennberg, claimed negligence, unseaworthiness, and inadequate maintenance under the Jones Act after a collision with the tanker 'Tropic Breeze' (IMO: 8906315) on December 23, 2021. The incident occurred approximately 15 miles north-northwest of New Providence Island at around 10:00 PM, while the 'Utopia IV' was en route to Bimini Island with seven charter guests and 12 crew members on board. Each plaintiff reported injuries sustained during the collision, leading to the trial that commenced on March 24, 2025, after the initial complaint was filed on November 22, 2022. While the defendants admitted liability, the jury's role was to ascertain the extent of the injuries and determine appropriate compensation based on the evidence presented. An accident report from the National Transportation Safety Board (NTSB) indicated that the collision was primarily due to the negligence of the 'Utopia IV' crew, who failed to maintain a proper lookout. The yacht was traveling at a speed of 20 knots when it struck the stern of the 'Tropic Breeze', which was operating at five knots while carrying marine gas oil and liquid petroleum gas. At the time of the accident, the captain of 'Utopia IV' had left the wheelhouse for 12 minutes, during which the bosun, unqualified to perform lookout duties alone, was multitasking and insufficiently observing the surroundings. Both watch crews on the involved vessels failed to register the other vessel on their radar systems, indicating a serious lapse in navigation protocols despite good visibility conditions. CCTV footage from the yacht captured the collision, which led to significant chaos on board, with equipment and crew members thrown against bulkheads. Of the crew, three reported minor injuries, including the captain, who was propelled into a bulkhead during the impact. Following the crash, the 'Tropic Breeze' was abandoned after flooding in the engine room, triggered by significant damage, and the crew had to be rescued by a passing vessel, the 'Amara', which diverted its course to assist. In total, the incident resulted in damages amounting to nearly $7.9 million, including the loss of 156,500 gallons of marine gas oil. While the 'Utopia IV' was required by maritime law to yield to the tanker as the overtaking vessel, both crews' failures to maintain adequate lookout contributed to the tragic incident. NTSB investigators concluded that the collision was a result of both vessels' watchstanders neglecting proper lookout duties, a fundamental requirement under the Convention on the International Regulations for Preventing Collisions at Sea, 1972. Utopia IV Collides with Miami Bridge Amid Strong Currents

Dec 17, 2023 19:28

On December 14, 2023, the luxury yacht 'Utopia IV' suffered a collision with a bridge adjacent to the Virgin Voyages terminal in Miami. The incident occurred as strong currents were generated by the departure of a nearby cruise ship, which was receiving tugboat assistance. The interplay of the tugs and the stern thrusters of the departing vessel created turbulent waters that surrounded the area. Unfortunately, these conditions overwhelmed the 'Utopia IV,' causing it to be swept away and collide with the bridge.

NTSB Reveals Insufficient Lookout Led to 'Utopia IV' and 'Tropic Breeze' Collision

Jan 12, 2023 12:09

The National Transportation Safety Board (NTSB) has released its findings on a serious maritime accident involving the yacht 'Utopia IV' and the tanker 'Tropic Breeze', which occurred on December 23, 2021, in the Northeast Providence Channel, approximately 20 miles northwest of Nassau, Bahamas. At around 6 p.m., the 'Tropic Breeze' departed from Clifton Pier, New Providence Island, cruising at five knots towards Great Stirrup Cay in a journey expected to last 12 hours. Simultaneously, at 8:30 p.m., the 'Utopia IV' set sail from Albany, heading towards Bimini Island at a speed of approximately 20 knots, charting a northern course around New Providence Island and north of the Berry Islands. Onboard the yacht were seven passengers and 12 crew members. As the clock approached 10 p.m., the bosun aboard 'Utopia IV' became focused on recording navigation logs, inadvertently turning his back on the forward windows. Coinciding with this moment, the master of the 'Tropic Breeze' left the bridge to visit his cabin. At precisely 10:00:48 p.m., tragedy struck as the yacht collided with the 'Tropic Breeze', hitting its transom from directly behind, slightly to the port side of the tanker’s central axis. The impact, occurring at a relative speed of approximately 15 knots, caused several crew members aboard 'Utopia IV' to be thrown across the deck, resulting in minor injuries to three crew members. In the wake of the collision, the chief engineer assessed the damage to the tanker, discovering rapid flooding in the engine room. Following a report to the master of the 'Tropic Breeze', who noted that the engine had failed after submerging, a VHF distress call was made by the captain about 15 minutes post-collision, prompting the crew to abandon ship. They launched both a liferaft and a rescue boat. While some crew members boarded the rescue boat, others used the liferaft. While the chief engineer was able to restart the yacht’s engines, the chief mate made a distress call via VHF radio and maneuvered the yacht to assist the crew of 'Tropic Breeze'. Despite efforts to lower the stern swim platform for safe boarding, high sea swells made it impossible for the stranded crew to board either 'Utopia IV' or the responding yacht 'Amara', which had arrived on the scene after hearing distress calls from the 'Utopia IV'. The crew of 'Amara' safely transported the crew from 'Tropic Breeze' to Lyford Cay Marina in Nassau, arriving at 2:40 a.m. on December 24. Tragically, the 'Tropic Breeze' continued to take on water and sank roughly 25 minutes after the initial collision. Both vessels were equipped with radar systems, which regulatory standards require to be actively monitored to identify potential collision risks. However, neither crew onboard 'Utopia IV' nor 'Tropic Breeze' reported any sighting of the other vessel on radar prior to the incident, suggesting a critical lack of oversight. The NTSB concluded that the collision was primarily due to the 'Utopia IV' crew failing to maintain an adequate lookout and failing to recognize the tank vessel they were overtaking. The inattentiveness of the bridge team on 'Tropic Breeze' also contributed to the disastrous outcome, emphasizing the vital importance of vigilance in maritime navigation.
