The ship successfully departed from the port later that evening and navigated under the Chesapeake Bay Bridge near Annapolis around 8 p.m., making its way to New York. Dejan Vodopic, the chief engineer of the cargo ship M/V Bellavia and a Croatian national, has concluded a plea agreement following nearly a year of detention by U.S. authorities due to allegations of environmental infractions. Represented by the legal team at Arent Fox LLP, Vodopic negotiated a plea deal that entails a probationary sentence and a fine of $15,000 for one count of conspiracy related to the failure to report a hazardous condition. In October 2013, allegations surfaced that Vodopic had discharged oil into the Pacific Ocean, breaching international maritime regulations. Consequently, Vodopic, along with 11 other crew members, was detained in the United States under a security agreement between the operator of the M/V Bellavia and the U.S. Government. This agreement allowed for the ship's release in exchange for the crew members' indefinite detention, without their prior knowledge or consultation. "Dejan and the other crew members experienced a lack of due process," emphasized Michael Zweiback, a former Assistant U.S. Attorney who led the legal team from Arent Fox LLP. This case highlights the serious implications of maritime law and the need for transparency and fair treatment of seafarers.

A significant fine of $1.25 million has been levied against the German shipping company Herm. Dauelsberg GmbH & Co. KG for failing to disclose damage to the cargo ship M/V Bellavia when it docked at the Port of Long Beach in 2013. The U.S. Attorney's Office confirmed the penalty on Friday, revealing that the damage may have resulted in a fuel oil leak into the ocean, prompting the environmental charges. The company pled guilty to two serious environmental violations: one for failing to maintain accurate records about the overboard disposal of fuel and another for not reporting the hazardous condition of the vessel to the U.S. Coast Guard. Assistant U.S. Attorney Mark A. Williams, part of the Environmental Crimes Section, emphasized the gravity of the situation, stating, "We think this is a very serious case and companies that come into our ports need to be completely honest with the Coast Guard. If they are taking advantage of our ports, they can’t dump oil and lie to the Coast Guard about it." The M/V Bellavia, a Panamax-size vessel measuring 960 feet in length, sustained a hull crack while traversing the Panama Canal in 2011. This crack worsened over time, allowing seawater to infiltrate a fuel tank. The situation escalated when the vessel was again subjected to conditions that caused further damage in September, information that the company failed to communicate to the Coast Guard. The crew of the M/V Bellavia reportedly discharged nearly 120,000 gallons of oil-contaminated seawater directly into the ocean without employing an oil-water separator, which is mandated by federal law for such discharges. According to regulations, the crew was required to both record the discharge and alert the Coast Guard upon arrival at the Port of Long Beach in October 2013. The matter came to light after four crew members provided evidence—including photographs and videos—of the fuel leak to the Coast Guard, resulting in their receipt of a $500,000 split from the fine for their whistleblowing efforts. The investigation involved the U.S. Coast Guard’s Marine Safety Office, the Coast Guard Investigative Service, and the criminal division of the U.S. Environmental Protection Agency, before reaching U.S. District Judge George H. Wu. On Thursday, Judge Wu imposed the maximum statutory fine of $1 million, in addition to a $250,000 payment to the Channel Islands Natural Resources Protection Fund to support environmental enforcement and public safety initiatives.
